17 January 2015 In a Private Company , I want to appoint one of Director as officer who is in default , pl. know me which which form I should file with ROC under the Companies Act, 2013

19 January 2015 the officer who is already is in default is a person disqualified by the law for being act as director of the company. so, such appointment is not stand valid.

if you want to tell that the person is in default and the company is willing to express him/her a defaulting one then in such a case DIR-9

19 January 2015 A person is not disqualified as Director currently , but we want to give responsibility to and designate one of the director as ' Officer in default ' , pl. know me which form I should file

20 January 2015 DIR-9 AS I ALREADY MENTIONED. this form is used to report to the ROC about his/her position of officer in default

Pursuant to Section 164(2) read with rule 14(2) of the Companies
(Appointment and Qualification of Directors) Rules, 2014
