Tds without income

Hi
one of my tenant has deducted TDS on rent for last ten days of march'14 & full month of April '14 while he has vacated on 21st March. The client has given form 16 too. Our billing is till 21st. My question is can we claim this TDS without income. There are other TDS deduction also to be made from tenant which is to be done, can the tenant adjust this tds with tds paid for march n April without income. Please help me.

If ur don't have other income in that year, than u can ask for ur TDs refund, and tenent can not adjust tds
