04 October 2010 Sir, I have retired on 31.03.2010. My employer re-engaged me for a further period of 2 months with usual terms i.e. I had continued up to 31st May 2010. Practically my service with my employer terminated on 31st May 2010. Now, MY QUERY is whether I should get the benefit of Notification No. 43/2010 [F.No.200/33/2009-ITA.I], dated 11-6-2010, by which Gratuity exemption limit was raised to Rs.10 lakhs.in case employees who retire or become incapacitated prior to such retirement or die on or after the 24th day of May, 2010 or whose employment is terminated on or after the said date.”

04 October 2010 No you can't get benefit of that notification because your servise has been terminated on 31-03-2010. the extention of 2 moths will be treated post retairement period of servise.
