23 July 2010 TDS has been deducted from the payment made to a PSU u/s 194A. actually the amount paid not liabile for TDS. the deductor requested the deductee to adjust the TDS from their regular TDS remittance under the branch of section 194 or any other section since, the deductor has issued the form_16A.

whether the deductee can adjust the TDS from their regualr remittance or not?

it is requested to advise in this regard and kindly send the case law if any for similar case.

23 July 2010 Since, the TDS has been remitted by deductor to the departmetn, and form_16A has alreday issued to the deductee, how the deductor can claim refund?

Kindly advise whether the deductee can adjust the TDS remitted as advance tax
under section 194.
