29 June 2013 I want to Ask service provider raised Invoice and charge Service tax while Service tax no not mention on Invoice.So,

1.Company are liable to pay service tax amount to service provider.

2.If Company paid Service tax amount so company can avail Service tax input credit.

29 June 2013 1) Service provider RC (Registration Number) is to be mentioned in his to avail cenvat benefit.

2) Not all services are liable to be paid by the service receiver. So, kindly reply as to what is the service provided to your company.

29 June 2013 Service provider has to necessarily mention service tax registration number in their invoice. This is mentioned in rule 4A(i)of Service tax Rules,1994 and notification 11/2004.

01 July 2013 Manpower supply to our company and vender charge ST 25% of 12.36 but service tax no not mention on thire invoice.

02 July 2013 As a Company and service receiver, 75% of the party's Bill for man power supply will have to be paid under reverse charge mechanism by cash and you can avail the CENVAT (input tax credit) based on your own remittance challan. Regarding party's 25% please advise the party to provide his RC number if he is registered. If not, you can not avail the benefit.
