11 March 2015 Dear expert,
there are Two director in the company remuneration is being given RS. 100000/- to each.
My Question is who is liable to pay service tax and what will be the ST percentage. if it
is cover under reverse charges than the 100% ST amount is to be paid by the company or not,

11 March 2015 100% service tax at 12.36%(presently)under reverse charge is payable by the company on payments made to other than whole time time directors.

11 March 2015 Dear sir,
one director is whole time and secound is part time. on behalf of whose director. the company is liable to pay ST whether whole time or part time.
100000 remuneration is being paid by the company, have to pay 12360 ST under reverse charge. but can we avail ST input

also note that. in this Query CA ankit Bohra has also reply he has mentioned ST doesn't apply to remuneration paid to director

11 March 2015 On behalf of part time director the company has to pay service tax.

can company avail the ST input of 12360/- under reverse charges....

11 March 2015 Yes input Service includes services relating to administration of company and hence Director’s services qualify for Input services. Therefore, Cenvat Credit can be availed of service tax paid on remuneration to Directors.
