Rebate claim timelimit clarification

06 August 2012 we have filed a rebate claims to the divisinal office of central excise, AC has rejected our claims under the ground of time barred.

my questions is that.

1.what are remedies are available.
2.if we go to commissioner appeal, can we get the rebate saction.
3.if any point of chance can we recredit the rejected rebate claim amounts.
4.what is procedure for reclaim of rebate

06 August 2012 Hello,

You can apply for refund of excise duty paid on export by way of "Rebate" from excise before one year from the date of export as per section 11 AB.

Now, the date of export is your LEO date.

If at all, all above are missed..then there is no easy option to recover these duties...except in CESTAT.
