only Agricultural income

27 June 2016 my father has only agricultural income 4 to 4.5 lac per year in 90 bigha land. my father never filled itr in any year due to non taxable income and now this year apart from this income my father's agricultural land ecquisised by govt and paid 8.8 lac to my father so this income is also non taxable or not and my father necessary to file itr or not and any proofs have to keep for record for in agricultural income. In my area cultivated crop is directly sold to brokers and they do not give us any bill or receipt of sale.

27 June 2016 if the person is having agricultural income ONLY, he need not file the income tax return.

27 June 2016 It is optional to file if you have only agricultural Income, in my opinion it is advised to declare agricultural Income so that you can declare your source of income.




28 June 2016 sir this year my father got 8.8 lac from govt against land ecquisised for road then it is necessary to file itr or not

29 June 2016 you need to find our whether the said land is URBAN agricultural land or not. If it is urban, then the capital gain is required to be worked out and then return should be filed

29 June 2016 Then is it EXEMPT? Have you checked it from some expert?

Sec 2(14)(iii) agricultural land in India, not being land situate—
(a) in any area which is comprised within the jurisdiction of a municipality (whether known as a municipality, municipal corporation, notified area committee, town area committee, town committee, or by any other name) or a cantonment board and which has a population of not less than ten thousand; or
(b) in any area within the distance, measured aerially,—
(I) not being more than two kilometres, from the local limits of any municipality or cantonment board referred to in item (a) and which has a population of more than ten thousand but not exceeding one lakh; or
(II) not being more than six kilometres, from the local limits of any municipality or cantonment board referred to in item (a) and which has a population of more than one lakh but not exceeding ten lakh; or
(III) not being more than eight kilometres, from the local limits of any municipality or cantonment board referred to in item (a) and which has a population of more than ten lakh.
Explanation.—For the purposes of this sub-clause, "population" means the population according to the last preceding census of which the relevant figures have been published before the first day of the previous year;
