Non Submission of TDS return While TDS amt paid

Could you pls tell me what would be the consequences of non submission of TDS return while TDS amt has been paid.
If we file it now then....

05 February 2010 Non filing attracting penalty of Rs.100 per day from the due date to up to the date of return (which doesnot exceed the TDS amount)

05 February 2010 In many Cases, people have a tan no. deduction is doing and also they deposit their tds in NB in time but they have not filed their tds returns for 2-3 years after 2005-06 even they have received letter from IT TDS dept. regarding non filling tds return cause to penalty u/s 272A of Rs.100 from defalut date, when they find that letter they filed their all qtrly return...but still no reflaction from IT tds dept. about penalty.. its depends upon case to case.
