Mvat on sale of under construction property

Can anybody let me know whether Mvat on sale of Under Construction property should be paid at 1% of Agreement Value or should it be paid at higher of 1% of Agreement Value or Market Value..??

It should be paid at higher of 1% of Agreement value or Stamp value determined by stamp duty officer(Stamp Value is mostly equal to market value)
