Regarding effective capital of ABC Ltd, please clarify my following query :

MD appointed on 01.06.08
MD resigned on 31.10.10

Company proposes to file Form 25A for waiver of excess remuneration paid to MD due to loss.

Company is adopting the financial year as JAN-DEC.

Query

for calculating the effective capital, which year should be considered i.e. 31.12.08 / 31.12.09 / 31.12.10 ?


Ans : ................ (my case falls under
Case a.)

01 November 2011 Capital taken of the year in which year the capital is higher but in in the year 2009 the MD work the whole year so it can also be consider.
