Can builder charge 12% GST for payments received upto 31.03.2019 & 5% from 01.04.2019 for under construction flats ?

Builder had given one time option , if builder opted for old rate (12%) on ongoing project , he will charge 12% even after 01.04.2019.
If he has not exercised the option , he has to charge 5% w.e.f 01 April 2019
If he has not exercised the option , he has to charge 5% w.e.f 01 April 2019
