GST ON PERSONAL MOTORCAR SOLD

This query is : Resolved

Quick Summary
Discussion is about GST applicability on sale of a personal motor car by a GST-registered proprietor. Views differ: one says no GST if purely personal use, another says GST may apply with marginal value adjustment even if ITC was not claimed due to mixed business-personal books.

20 March 2026 hii!!! i am individual , my proprietary concern is registered under GST, i brought new car for my personal purpose , i had not given my GST number to car dealer. my personal books of account and my business books is same. no separate books of accounts are maintained. so i sold the car, do i have to charge GST on the motor car supply ???

20 March 2026 ✔ No GST on sale of car (most likely)
BUT ⚠️ Subject to proper justification of personal use

02 April 2026 Yes you have to charge GST on disposal of car even if you have not taken ITC on it but you can take the benefit of marginal scheme by paying GST only on difference value i.e. between WDV and sale value.
