Form 3CA or CB

09 September 2009 I wish to know which audit Form required in Tax Audit of a Limited Company whether 3CA or 3CB ?

Please give full detail in this regard.

09 September 2009 Form No. 3CA.
The rule is as under:
76[CCC.—Reports of audit of accounts of persons carrying on business or profession

77[Report of audit of accounts to be furnished under section 44AB.

6G. (1) The report of audit of the accounts of a person required to be furnished under 78section 44AB shall,—

(a) in the case of a person who carries on business or profession and who is required by or under any other law to get his accounts audited, be in Form No. 3CA;

(b) in the case of a person who carries on business or profession, but not being a person referred to in clause (a), be in Form No. 3CB.

(2) The particulars which are required to be furnished under section 44AB shall be in Form No. 3CD.]

09 September 2009 My company does not required audit in any other Law. Now as u explained Form 3CB should be used but when an auditors give auditors report under company act , does it mean audit under companies act and Form 3CA required.Plz Clear.

09 September 2009 Your company being a corporate assessee (limited company) and if the turnover is less than Rs.40 lakhs per annum audit under The Companies Act,1956 and audit report under that act is enough.
If the turnover exceeds Rs 40 lakhs per annum apart from audit under The Companies act, 1956, tax audit under section 44 AB of The Income tax Act,1961 is also to be done. Accordingly tax audit report in form 3CA and details in form 3CD is a must along with audit report under The Companies Act,1956.
