30 July 2016 my client filed itr 1 in the year 2012-13 and from that day he leaved job. In the year 2015-16 he got another job. Between 2012-13 to 2014-15 whose income is less than exemption limit and he was not filed income tax return. In the year 2015-16 he got job and his income is taxable. Now he want to file itr 1. Please tell me can he file return for 2015-16. what is the objection of income tax department for 2013-14 and 2014-15?

30 July 2016 Your client is not obligated to file the return of income if his income not exceeding the maximum amount not chargeable to tax for the respective assessment year. He also need to check the first proviso to section 139(1) regarding 1/5 conditions.

He needs to file return of income for the assessment year 2016-17. He may file in ITR1 if his total income consists of salary and One house property, Other sources (Interest etc.).
