Filing of first annual return under co. act 2013

23 November 2015 Dear Experts,

Please let me know whether a Company incorporated in the month of November 2014 required to file AOC 4 and MGT 7 and if Yes what is the due date? and is it within 9 months from the closure of financial year?

23 November 2015 As per provisions of Companies Act 2013, this company can have AGM till 31st December 2015. And AOC-4 is required to be filed within 30 days from AGM date and MGT-7 is required to be filed within 60 days from AGM date.

Please correct me if I am wrong,

So as per Companies Act 2013, A company incorporated in the month of Jan to March 2015 is not required to conduct its AGM and file annual returns in the year 2015. It can file the returns is 2016 itself.
