A company has purchased car under hire purchase with a Pvt Finance company. Finance company has not insisted on filing e-form 8 for registration of charge. Is it necessary to file e-form 8 with ROC, though the finance company not insisted on the same?

As Hypothecation is a kind of Pleage. And pleage is excluded under section 125.
