24 May 2009 The provisions state immediately. However as per the decision of the SC in the case of Formica India division, benefits available under law cannot be restricted when there is a duty demand.
Ideaaly - within 1 years not dispute
1-3 years - some dispute possible but within limitation act ( to what extent that is applicable not knwon)
Over taht - disputable though support of case laws exust.
