I would like to know whether a company who has stopped its operations from last 1 year i.e. 2010 can also avail the EES scheme as the company has not filed any of Annual return with ROC since its incorporation.

15 March 2011 No. Can not apply under EES-2011.

It is for companies which is not carrying over any business activity or operation

* On or after 1st April 2008; and

So can not apply to EES 2011.
