I HAVE ONE CLIENT IN WHOSE PRIVATE COMPANY THERE ARE 3 DIRECTORS. OUT OF WHICH 2 DIRECTORS ARE ALSO A DIRECTOR IN A DORMANT COMPANY. NOW I WANT TO APPOINT 3 NEW DIRECTORS BUT WHENEVER I AM FILING FORM NO 32
IT ASKS ME TO SUBMIT FORM NUMBER 61. NOW I WANT TO KNOW DO I NEED TO FILE FORM NUMBER 61. KINDLY HELP ASAP.

Yes, you can not use the digital sign of such director to sign e-form unless the all 9 company comply the annual filing.
The MCA has implemented indirect way to file pending annual forms with MCA by such dormant company.

The DSC of defaulting director can not be used in signing e forms in respect of fresh companies.He can only sign the e forms in case of defualting companies.
