19 January 2015 sir my daughter is doing work at metro hospital delhi they give her to profesional fee u/s 194 j.can she claim deduction u/s 80GG ? and how much amount ?she is living in rental house

19 January 2015 While it is possible to claim a refund of the TDS by filing a return, it is also possible that a certificate for low deduction of tax at source can be obtained from the assessing officer. This would arise because the reader may be entitled to a deduction under Section 80GG in respect of the rent paid. The deduction under Section 80GG is available to an individual to the extent of least of the following:

1.25% of adjusted total income.
2.Rs 2,000 per month.
3.Rent paid (less) 10% of adjusted total income.

Adjusted total income here means the income computed after all deductions other than a deduction under Section 80GG. Deduction under Section 80GG is available only if the following conditions are satisfied.

1.The assessee is not in receipt of House Rent Allowance
2.The assessee or his spouse or minor children do not own a residential house in the place where the assessee resides or is employed or carries on business
