19 February 2010 Sir,

One of the assessing officer given certificate under section 197 by mentioning that tds to be made @1.75% for the year 2009-10 on some particular items on 05.11.2009,accordingly we are deducting TDS @ 1.75% for the year 2009-10 on the particular payments mentioned in that oredr.


But our TDS assessing argued that the certificate is come into force from 05.11.2009 payments onwards but not for prior payments and not accepting TDS @1.75%.


Pl claifiy me whether the contention of Our assessing officer is correct,even though the oyher company assessing officer in the rank of Addl. commissioner is given that certificate.

19 February 2010 The assessing officer is correct. The rate is valid after issuance of the certificate and not for invoices prior to the date.
