Spouse income clubbing

Husband's(H) gross income is much higher than wife's gross income. Wife(W) gives her professionally earned money to Husband (H). H opens FD with bank & invests remaining part of that money in stock markets on his name. Bank deducted TDS with H PAN and all transancation done in stock market are with H PAN.

Is there anyway that the income from FD and stock market investments can be reasoned as belonging to W for income tax purpose? Please note that H's individual gross income is higher than W's individual gross income.

Deferred Tax

For calculation of Deferred tax relating to timing difference arising out of fixed assets, do we take the difference between WDV as per books and WDV as per Income tax; or do we take the difference between depreciation as per books and depreciation as per Income tax act.

duty on downloads

during jan 2007 we have remitted some lakhs towards purchase of software from US. payment was made through bank via TT, after completing all formalities. later we were permitted to down load the entire software through internet. we have not remitted customs duty as usually we are paying at the time of clearing the goods. here there is no clearing process.then what about the customs duty on this purchase.and how to remit, if avoided what will be the consequences.

Service Tax Cenvat Credit

Dear Friends,

Please clarify the following

The assessee is a manufactuing co and not a service provider. The co has liable to pay the service tax on (freight) carriage outward.
1.Is it the co can set off its service tax credits taken for paying the service tax on carriage outward?

2. For the service tax liability (i.e service tax on carriage outward) can it set off against the cenvat on excise on inputs.

EXCESS PAID SERVICE TAX

WE HAVE PAID EXCESS SERVICE TAX TO THE GOVT THAN WE COLLECTED IN THE FINANCIAL YEAR 2006-07.
MY QUERY IS THAT, CAN WE ADJUST THAT EXCESS PAID AMOUNT IN FINANCIAL YEAR 2007-08.

IF IT IS POSSIBLE, KINDLY GIVE THE PROCEDURE TO BE DONE FOR ADJUSTING THE EXCESS PAYMENT.

KINDLY PROVIDE THE RELAVANT RULES OR NOTIFICATION.
