If an assesse is trading in equity and f&o both intraday and short term and his turnover is below Rs 60 lakh(1 cr now) and he has incurred a big loss only does he have a choice as per rules to opt between filing u/s 44AD and regular filing.

I got notice of demand u/s 156 to pay tax.
Sir, I paid tax of Rs.4610/- by July,2013
& took deduction u/s 80C, 80D & 80TTA Chapter VIA.
They didnt consider my 80TTA deduction & send me notice for tax amounting to Rs.510/-.
So, What should I do?
Wheather should I pay for the same or is there any other alternative option pls suggest me.
