Loan from employee

Can a private company accepts loan from its employee?? if yes/no plz mention logic behind this and applicable provisions??

I am full time salaried employee.
I have traded in Futures & Options only for 5 months (September to January 2008) and have incurred a loss of 62K in F&O and loss of 12K in Short term investment in Equities for full year.

I have clubbed both the losses 74K as Capital gain loss and filed in ITR2 form under Capital gains.

Since i am a full time salaried person, all my trading has been carried out by my broker on behalf of me, can i consider my F&O trading as Investment and declare the losses under Short term Capital loss.

IF i should have filed ITR4, now what is the way to set right these mistake...

TDS

There is a queary regarding TDS. we are the civil contractor and carrying out eraction of towers as civil contractor TDS is 2.06.

Now, the company has paid us Rs. 200000 as part payment of bill insted of Rs.1000000 as full amount for the bill of last financial year and deducted full amount of TDS in last year and company will pay the rest amount in this year. whether is it tenable? what should be the accounting entry? and how i can claim refund and show my income of Rs.800000?

Filing of Income Tax Return

I am doing three different prop concern. I am filed my income tax retun in 2 months before for the asseement year 2009-10 with my my 2 prop concern income only. Because at the time return filing my 3rd concern accounts not finalised.But my bankers wants urgently i do that.Now i wants to file my revised return with my all 3 prop concern.my gross receipts not exceed rs.10 lacs.In this situation any problems created by the assessing officer at the time of assessment.Please advise me what i do?

HRA/House propery loss

Dear All,

I have a residential house in hyderabad where my mother is staying(i'm paying principle & Interest).I stay in another area in a rented house due to my employment, but in the same city.

My question is can i claim HRA & House propery loss in my self declaration while giving to Employer.Does the employer has right under any section of IT act to reject the same.

Please clarify with case laws/sections if any.

Appropriation of Profits

Helloo
I wants to ask that a housing society has been newly formed and no audit was conducted in the F.Y 2007-08 but in 2008-2009 however audiy has been conducted and only sinking fund has been created,But as per Bylaws of Society out of the profits after interest ,25% should be transfereed to Reserve Fund .Is I am correct please suggest whether any other fund needs to be created.Its urgent

AS applicable to Civil Contractors

I want to know which Accounting Standard is applicable for recognising revenue in case of a Civil Contractor - AS 7 Construction Contracts, or AS 9 Revenue Recognition.

The individual is engaged in pure civil contract works, which includes, Painting, renovation, Repairing etc of Buildings, Flats, etc, and specifically does not include Construction, or Redevelopment projects.

Para 8.3 of AS7 mentions that
"Contracts for rendering of services which are directly related to the construction of assets" are to be classified as Construction.

The question that arises here, is that whether a Civil Contractor can be covered under AS7 on the basis of the above-mentioned grounds or not.
