Under service tax What is the Simple Meaning of declared services? and what is the Differance b/w declared service and negative list?

I have a query related to service Tax. My company raises invoice and pays the service Tax but later in maximum cases it receives an amount lesser than the invoice amount and service tax thereon. So we are ending up making excess payment of Service Tax based on our invoice value whereas our actual receipt is less. So can we claim the refund for excess payment of Service Tax. If yes, what is the procedure to claim the refund.

In my company We are paying rent to the land lord from FY2010-11 to till now.
We paid 10L first year and second year also we paid 10L. Please let me know are we liable to pay services tax from the second year. As per my knowledge If we cross the 10L every year only we liable to pay service tax. Please I want to know are we liable or not?

I have started my training on 1st Apr 2011 and going to finish it on 31st Mar 2014.
But for my final exam (provisional attempt on NOV 2013), I have taken a leave for 45 days including sundays and festival holidays during Oct and Nov 2013. If I deduct the sundays and holidays my leave roughly comes to 30-35 days.
For this my employer had deducted the stipend for these 45 days. Moreover what if he asks me to work for 45 more days after 31st march. Do I have to work for 45 days more, or these leaves are allowed as these does not constitute an excess leave.
Working (as per me) is shown here:-
No of leaves allowed=
1/6th of (1095-45)=175 days
So I can avail 175 days leave. But I have availed only 30-35 days.
Am I correct or I have to work for these 45 days and whether stipend deducted is correct.
Please help.

An assessee has a building consisting of 3 floors.
He has rented one floor I to a company.
The other two floors i.e Floor II and III contain machinery which are let out to another company along with machinery.
Can the assessee declare the income from floor I under house property and income from Floor II and Floor III under the head business/profession and claim depreciation on building and machinery used in those two floors.

Now i am filling ITR form than there is no place or box to entered penalty amount.

An assessee has CENVAT credit unutilized around 12 Lakhs since 2010-11. He has stopped the commercial activity of the business and there is no chance of carrying out the activity in future years also. Can he claim any refund of the CENVAT credit.
