1 employee of my company leaves the job on 31.07.11 for 3 months and he comes back after 3 months and his his salary increas from 01.04.11 to 31.07.11 now he wants his 4 months arrear, what is procedure ?

As the revised schedule VI is applicable from 1.04.2011, what would be the implications if the company gets it accounts prepared as per revised schedule VI for the year 2010-11.
Will it be non compliance if the accounts for the year 2010-11 are not prepared as per the existing Sch VI provisions since the legal validity of revised sch VI comes into effect from 1.4.11.

A company is engaged in the development of ports. For financing the development, it had applied for an ECB. While it was waiting for the sanction of ECB by the lender, it had obtained short term rupee advances from its group companies to meet the expenses related to the development of port. Now the ECB loan is sanctioned and the funds are received by the company. Can the company utilise the ECB loan amount to repay the short term rupee advances it obtained from group companies?. Will it be covered under the end uses that are not permitted as per the ECB norms?

Ours is listed Company.
Our Board Meeting was held on 28th April, 2011 for considering Unaudited Financial Results for the quarter ended 31st March, 2011.
After that our Board Meeting held on 10th August, 2011 for considerting Unaudited Financial Resuls for quarter ended June, 2011. There is gap between two Meetings are more than 3 months ?
Is there violation of Companies Act ?

We are URGENTLY in need of a corporate lawyer who can help us solve the dispute in a Pvt. Company.
The company ABC was found with capital from two brother 50-50%. Now one of brother who is managing Director ocuppied the factory, hire guards and not allow the other brother come into factory. This brother - managing Director had opened another company working in the same field and using all machines, materials of company ABC which is under dispute to do manufaturing for his own company.
Now what the other brother can do to stop IMMEDIATELY misusing machinery and materials according to law when he has no papers, document in his hand since he is not allowed to ascess the company premise. The managing Direstor also do forge signature and cook the book to make company ABC into bankcorrupt. EXPERT Please help. We need your advise!

Hi, i am going to start a private limited company. We are three people. Out of which two people are Permanent Resident of Australia. They are Indian citizens too having a valid Indian PAN card. They have worked for Indian companies in India as well. I want to appoint one of them as director and shareholder, and the other one as only shareholder (not director). My question is: can they be Director and shareholder in my company as well as carry on their existing jobs in Australia? Can they be taxpayer in both the countries India and Australia? Scope of our new company is totally different from their existing jobs and areas of both does not conflict at all.
