We are an authorized dealer of the product of Ashok Leyland Ltd in the state of Rajasthan.
We provide service in relation to repair & maintenance of motor vehicles(including heavy commercial vehicle/light commercial vehicles/cars etc.).In the course of servicing we take some support from outside also.
Part of service process is carried by the outside service provider & rest by us.
Then we make the bill with full amount on customer including service tax.
We take the input of service tax charged by the outside service provider for providing service of repair & maintenance.
Are we right in our approach?

Is there any effect in income tax liability for the non payment of Service tax ?. If so, to what extent ?

Our client has provided invoices to L & T Co. with service tax but the payment was actually made by the company without service tax. No service tax is paid as there was dispute, company said that it will be reimbursed after payment made by our client while client said that it will be paid after payment made by company. During dispute period of 5 years, he was not our client.
Now summons from service tax department is received.
If the payment of service tax for the last 5 years is made now, can company claim full input credit for the above mentioned 5 years. Limit of 1 year’s input credit is intoduced w.e.f. april, 2014. Invoices raised before April 2014 are eligible for input credit now ?
under rule 9(7) of cenvat credit rule 2004
which return we need to file on half yearly basis
Sir Can we take service tax CENVAT credit of service tax which paid by c & F agent for commission on sales (Domestic sale) with proper document and within time limit? in ref. of cadila case , local excise office inform us we are not eligible for taking a cenvat credit of services provided by Consignment Agent and is require to reverse all the taken credit? Our Plant is located at GUJARAT.

Our company has given contract to build a building on labour contract. Material is provided by the company. Contractor is Individual. Please confirm the rate of service tax to be charged by contractor on his labour bill and who is liable to pay the service tax,

Dear Sir,
We are a pvt ltd company and engaged in the transport of goods.
We receive the goods from another Pvt Ltd Company and send this to other individuals, firms and other companies by using our own truck and hired trucks.
Please clarify whether service tax is payable by us if yes the rate of service tax and whether we need to collect the service tax or to pay from own pocket as per reverse charges.

Dear Sir,
We r a Pvt Ltd Co. , receiving a loading/unloading service (through Hydra/crane) from a partnership firm.
The Service provider is providing both services (a) GTA (b) Loading/Unloading.
In GTA , we paid s.tax @ 14 % after abatement.
But confusion is that whether loading/unloading services is attract service tax liability or not.

One of my client was in receipt of advance of Rs. 1,00,000/- in the month of may 2015. and he paid service tax @ 12.36%
Now he is issuing a bill to his client in the month of september 2015 of Rs 4,00,000/- @ 14%
so what would be service tax treatment while paying and in the accounts as well.
