Gratuity

Mr.X was an employee of xyz enterprises.Later during the period of 2008 xyz enterprises was converted into XYZ PVT LTD.The total period of service rendered by Mr.X in XYZ enterprises and XYZ PVT LTD in aggregate exceeds 5 years.
Further XYZ PVT LTD is registered under shops and establishment act and has not completed 5 years of incorporation

Is xyz pvt ltd correct in paying gratuity to Mr.X considering the period of 5yrs(in both )
Mr.X has retired.

Passport application (urgent)

Dear Expert,

When i was 6 month that time i and my mom dad migrate from nepal after that i never gone to nepal i permanently settle here. I did my schooling and graduation from mumbai and I had all proof of identity & Resident like PAN, Votor ID,Ration Card,Adhar,Driving Licence,bank paasbook and College Leaving Certificate. I had applied for passport by registration / neutilization what certificate they will demand for place of bith? or should i have give affidavit?


Please give your valuable suggestion as earliest.

Pf deduction

Dear Sir,

Is it mandatory for a company to make PF deduction from each & every employee where some employees are not interested to make payment for PF (Provident Fund) ?

Provident fund

Can a company deduct PF on the basic wages of employees having basic wages more than Rs 6500 pm. My co. is deducting PF of all the employees. Employees do not have any objection as it is beneficial for them but is it a loss for the co. or not. Please tell me whether the co. should do it or not.Is it a offence or loss fo the company????

An Indian private company having foreign directors and having low net worth can issue shares at premium or not???? And also tell the maximum limit of premium amount. Is there any litigation against RBI rules & Income Tax rules regarding the issue of shares at premium having low net worth???

If a company is listed on a regional stock exchange & wishes to get listed on BSE Ltd. What is the procedure to be followed & the criteria to be listed.

Does anyone have any checklist in this behalf ?

Hello Sir,
ESIC is deducted if the gross salary is 15000 or less, but when an emplyoees get salary more than 15000 p.m and due to his leave he get's salary less than 15000 whether to deduct ESIC or not.
Same case with PF, due to leave one's salary that is basic salary+DA becomes less than 6500 then should we deduct.
