Dear all There is one manufacturing concern ...they have newly started their construction of Factory building work..for construction they have purchased construction material from Manufacturer/first stage dealer like cement,Plates,channels,pipe,sand after paying excise duty on such material for factory building. and they also used such material on Machinery foundation....My questions is can we take cenvat credit on such materials and can we take it as capital goods. Please advise me....

while auditing the excise records of a paper manufacturing company , it comes to my notice that the company is taking cenvat on some raw materials , not on all the raw materials. why so? Basically in colors & chemicals.

1) A COMPANY WISH TO SEND GOODS FOR JOB WORK OUT OF INDIA AS SPECIAL OPERATIONS ARE REQUIRED.
2) GOODS WILL BE RETURNED BACK TO INDIA AFTER COMPLETION OF JOB WORK.
3) IF SOME JOBS ARE SCRAPED AT THE TIME OF MACHINING, THEY WILL NOT BE RETURNED BACK. WHETHER SUCH REJECTION SHOULD ALSO TO BE BRING BACK?
4) WHAT WILL BE THE PROCEDURE UNDER EXCISE AND CUSTOMS? ANY PERMISSION REQUIRED? CAN ANYBODY GUIDE AS PROCEDURE IS NOT FOUND IN EXCISE BOOKS.

My Client had just started to trade its branded products manufactured by him. The retail price per product will be less then rs. 1000/-. Now is he is liable to get it concern registered with Excise and pay the duty. if yes then at what rate. And also if he is trading some of it goods then is excise is applicable on it.

Kindly share your valuable opinion on the following :
An manufacturing company (A) registered under excise & service tax is manufacturing excisable goods. Company (A) is also doing contract manufacture of exciseable goods for its client (B). The client (B) is providing all raw materials on which manufacturing company (A) is availing cenvat credit and paying duty on value addition as per the practice prevailing as per case law Ujagar Prints. The manufacturing company (A) is also utilizing some services for their own excise manufacturing as well as contract manufacturing. Kindly provide whether cenvat credit is admissible for services utilized in both the cases to company (A).
