Dear Sir,
We are manufacture of Cookwares which are covered in under tariff heading 73239390 taxable rate @ 6% ( Notification 02/2011 Sr.No.53). We have cenvat credit balance and we are paying excise duty by debiting cenvat account. Now we are exporting product so we have some below question.
1. Can we export with full rate of duty i.e. 12.50% under rebate ?
2. Can we charges the duty in some case 6%( Notification 02/2011 Sr.No.53) and in some case 12.50% or we will have to pay duty continuously with same rate.

Please help in this matter with the help of valid provision of excise act.

Use of central excise registration

Dear Sir/Madam,
I have a query regarding registration for Central Excise.
One of our client is importing raw material from registered supplier in abroad. He is paying excise duty more than cost of material.,suppose cost of material is Rs.6000.,he is paying excise duty Rs.8000.
Can he avail tax benefits if registered under Excise Authority? If so, please suggest me the procedure in detail.

Thanks in Advance.

hello friends
one of the my clients being Private Limited receiving SCN from Assistant Commissioner

Actual Situation:
All Records (including PLA 23A-I & II) as per Provisions of Excise Act are maintain accurately daily basis. Duty Debit and credit in books of Account are correctly but in ER-1,Debit entry of Duty is omitted so in next month, Duty are debited in ER-1.

According to SCN:
1. Penalty and Interest for Belated Payment of Duty
2. Central Excise duty was actually paid by the assessee through Cenvat Credit which was payable through Account Current in the view of Department.
(i) All Goods valued at Rs. xxx involving duty of RS. xxx shall be liable to Confiscation under Rule 8(3A) of Central Excise Rule,2002
(ii) Central Excise duty amounting to Rs. xxx was demanded through Account Current
(iii) Interest and Penalty.

ANY ONE ADVICE OR SUGGEST ANY CASE LAWS / NOTIFICATION
