MRP Sale + Free Gift (Valuation)

Dear All Experts

I need your valuable suggestion in the following matter.

Ours is the Ceramic Tiles & Sanitaryware Industry. Tiles are cleared under MRP Valuation (Sec 4A) and Sanitaryware is cleared under Sec 4. (advolerm)

Further for promoting of our Tiles Sales we want to give sanitaryware items as a free gift alongwith Tiles to our customers.

My query is whether the duty is payable on the clearance of Sanitaryware items which are cleared alongwith Tiles as a free gift. If yes, what is the procedure for valuation.

Thanks in advance.

Job Worker

when we transfer goods to job worker & he again transfers back such goods after carrying conversion processes(manufacture)....there Rule10A of Valuation Rules 2000 applies..
and the value of goods on which duty will be levied is the sale price by the principal manufacturer at that time

But if the principal manufacturer himself uses such goods and carries out manufacturing process on it then what will be the value on which duty will be levied??

A. Kiran Kumar

Request you to kindly clarify my doubt, whether 100% of Cenvat credit on Capital Goods can be availed in the subsequent year; in the case of no cenvat credit availed in the financial year, in which the goods were received.

Thanks in advance
