If an assessee providing service of Transport of goods by road is exempt from service tax payment since the recipient is liable to pay it, then under which notification, both prior to 01.07.2012 and after that, the assessee can claim exemption while filing the service tax return?

Our company recd advance against export. Due to some problem export is not done & we have refunded more than 92% export advance. Now we want to refund balance amt to the party & period of one year has been lapsed. There in no transaction in our bank except Receipt & payment of export advance.

My client who was running his business as a sole proprietor is no more and hence his legal heir is willing to cancel the Proprietorship registered under my client's name.
