asking for form no.16

One of our workmen is asking for Form No.16 where as his taxable income is lessthan Rs.1.40 Lakhs. Further he is putting pressure throgh one of the Auditor.

Now my question is

Is it mandatory for the Company to Issue Form No 16 eventhough there is no taxable income & no tax is deducted?

If the company Doesnt issue Form 16 to the employee what will happen?

Kindly Clarify the matter.

14 March 2010 if income is less than the exemption limit and the TDS not deducted from the Employee form 16 issue is not mandatory . if the employer is not issued form 16 for that employee.no consequences

For the AY-2010-11 the new form is there Form 16AA(specialy for salary below Rs,1.5.lakhs). you can check and issue that
