12 June 2013 Dear Sir,
One of my client provide skilled labour to Floor mills for the installation of plant machinery.
Now please advise me on following points -
1. if he wish to obtain service tax registration then which service code is to fill in application form.
2. in the column of name of applicant he should fill his own name or his firm name.
3. what is the applicable rate of tax that he should charge from floor mills.

Please find below the pointwise reply :
1.As per your statement, you have provided skilled labour to floor mills, then you have to select the manpower supply or recruitment agency service in the application form.
2.If he wish to obtain registration in the name of his firm, firm name shall be filled.
3.the present rate of tax applicable is 12% service tax and 2% education cess and 1% secondary & higher education cess.

I hope that this will suffice your requirement.

12 June 2013 In the 2nd point I wish to add some, that if I apply in the name of firm then there is a coulmn - Name in PAN card, here I have to fill assessee name because PAN is his name.
Whether this mismatch will casue problem?
and
if he obtains registration in his own name then bank person denies him to open his current a/c in the name of firm, by saying that registration is in your own name.

Please suggest any remedy.

13 June 2013 Dear Friend,

Reply for 2nd Point:-
Please put the name of firm in the column Name of applicant in ST-1 Form and put the name of person in column Name of application (As appearing in PAN) and select the constitution of applicant as proprietorship. This is ok and you will be able to submit your st-1 form for getting sevice tax registration.
