Uk citizen wants to purchase flats/shops in india

We are basically builders and developers.One of our relatives is settled in UK having citizenship of UK who had remitted to us into our bank account a sum of British Pound 4,00,000/- [ equivalent to Indian Rupees 4 Crores ] on account of advance against purchase of flats/shop. Now he has taken 100% possession of flats/ship as per mutual understanding. Whether registration of property in not allowed in this case the purchaser being foreigner.

Notification No. FEMA 21/2000-RB dt. May 3 2000 allows property purchase by PIO(foreign national of Indian origin).
