If Transporter submit PAN Card copy then tds deduction not required.
if transporter not owned trucks then also this rule will applicable or not.

The only requirement is that the contract should be in the nature of plying, hiring or leasing(transport business - for short) of Goods Carriage.
The relevant section does not require that the contractor should be owner of the goods carriage.
In my view, the contractor engaged in transport business is covered by the exemption, on furnishing PAN.
