03 January 2013 TDS was deducted by employer but the same was not paid to the government. The liability was shown in the balance sheet submitted to the dept.Later on, it was known that the employee was not liable to deduct the TDS as his income was below the exemption limit provided.

Whether still employer needs to pay the TDS amt with interest? If he does dat, employee will again need to claim refund of the same.

Also, the above expenditure will be allowed u/s 40(a)(ia)?

03 January 2013 In this case employer will be liable to deposit tax deducted. Employee advised to get Form 16. Also no amount shall be disallowed u/s 40(a)(ia) since salary is not mentioned therein.
