SOLUTION TO TAXPAYER WHI HAS NOT FILED A SINGLE GST RETURN

28 April 2018 One of my client in harayana has failed to file Trans 1 ( Having credit of 3lakh) and GST return since July 17 and having a turnover of 40lakh per month ( 80 % are exempted sale). Problem is we are unable to file current GST returns due to earlier default. 1. Is there any alternate to claim tax credit during transit? 2. How the default can be made good without paying penalty? Please provide the solution

29 April 2018 1. No way 2. No way.

13 May 2018 1. The due date for filing TRAN-1 has expired. So the unutilized credit cannot be carried forward into the GST regime. Refund will have to be claimed in the erstwhile tax regime.
2. File GST returns of all the months immediately. Late fees will have to be paid. There is no option of filing the returns without payment of late fees.
