service tax set off with cenvat credit

22 October 2009 Sir,

we are manufacturing unit with huge cenvat credit. can we set off the service tax liability on goods inwards and final product outwards?

22 October 2009 It appears that you have Cenvat Credit on account of tax paid under GTA service.

So far credit on goods inwards, there is no dispute regarding its availability of credit.

So far credit on outward transportation is concerned, it is a pretinent dispute between the assessee and the department. Unable to comment on this aspect.

22 October 2009 we have huge cenvat credit on account of Rawmaterials, capital goods and some with service inputs. The question is can we set off these cenvat credit against unpaid inward GTA services and finished goods outward transport services with unregistered transporters?

22 October 2009 Cenvat can not utlized for set off service tax libility.

service tax can utilized for set off duty of finished goods.
