Service tax on rent received on commercial property

19 December 2010 One of our client is not paying service tax portion on rent paid to us for commercial property. According to them there is stay regarding this matter in delhi high court.
Please provide me solution in this matter

19 December 2010 There is no stay on the matter. Moreover with the retrospective amendment in Finance Act 2010, the matter is settled. Please explain the customer accordingly.

Moreover, if he is not paying the ST portion, then the income has to be adjusted and tax amount deposited to the dept.

19 December 2010 There is a stay on this matter by Delhi High court among others. Supreme court,learned from news paper reports, has directed the former to take up the case for hearing in last week of january,2011 (24th or so). Hence cannot be commented upon being under sub judice.
