Service tax arrears paid

This query is : Resolved

30 March 2009 One of our customer has paid service tax for 15 months when he cames to know that he is liable to pay. This is due to service tax paid on immovable property. Can we take credit upon payment with Excise duty liability?
The period 15 months as mentioned earlier also covers 10 months prior to registeration during which he was not registered with service tax dept.
Please clarify with relevent tule or case laws

31 March 2009 For which period it has been paid is not relevant.

Criteria is the amount should have been paid, and reflected in the Invoice with break up of 12% , 2% and 1%.

Even if it for earlier period during which registration was not available, credit can be availed
