20 February 2010 MR X is a director in a xyz private limited company.Mr X is also proprietor of Mr x & co.(chartered accountants).

so my query is
1)whether Mr x Can be the auditors of the xyz private limited

2) If yes then, whether he can file ROC return of xyz private limited company as his name as auditors.

3) whether there can be different name of auditors in balance sheet & roc return for the particular financial year?

pls solved my query with suitable supportings,

20 February 2010 No. A director can not be appointed as statutory auditor of the company u/s 226(3) because he is an officer of the company u/s 2(30).

20 February 2010 so what steps can be taken against the auditor?

20 February 2010 Appoint some other auditor. If you have been showing his name as director as well as the auditor, definitely, you would have to face some query from the ROC
