11 December 2013 If your client can pay the fee for rectifying the defective return along with the fee for return filing, you can do so as return filed without paying SA tax is treated as defective return.

In spite of this, tell your client to manage the tax amount pay it right now.

A Return of income is regarded as defective unless it fulfils all the conditions laid down in section 139(9) of the Income Tax Act, 1961. The Finance Bill, 2013 ammended 139(9)stipulating that the return of income shall be regarded as defective unless the tax together with interest, if any, payable in accordance with the provisions of section 140A has been paid on or before the date of furnishing of the return.
