What are the provisions and procedure to restore a striken off company according to new companies act.

Rules are not notified yet, though draft released in October 2013. Therefore, procedure laid down in section 560(6) of the 1956 act can be followed meaning thereby file a petition before the jurisdictional high court.

1) File a petition u/s 560(6) of the Companies Act,1956 before the jurisdictional high court for which you may give vakalath to an Advocate in practice.
2) If favourable order is received, the court may generally put three conditions viz.,
a) to file a copy of the order to ROC which may done by e-filing form GNL-1
b) to pay an amount towards reimbursement of ROC'S court expenses which may be done through 'pay miscellaneous fee' option available in MCA portal.
c) to update e-filing of all pending documents including annual filing forms.
3) If the court order is complied ,with in the time allowed , name will be restored in the register maintained by the ROC.
