Hi,
plx sme1 answer this is urgent.
if i pay charges for advertising of $150 to a person who has a pe in india, but the charges are paid to the foreign unit and for advertise outside india, will that person be entitled for the Rs. 20000 threshhold limit i.e will i have to deduct TDS as the payment is less than 20000.
And also the foreing unit is in USA. so will i have to apply for 15CB.

As per Section 9 this income will arise in India and hence will be applicable for TDS(I have assumed that advertisment is not related to collection of news by news agency outside India in any manner). Your query is not clear as at once place you are saying that it has a PE in India and on the other place you are saying that you are remitting the amount outside India. Please make it clear because this will change the section applicability.
