Regarding creation of charge

A firm has an outstanding loan . Later on firm is converted into Pvt Company . Is it necessary to create charge ?

Yes. Inference - section 79(a) of Companies Act,2013.

Thanks sir !!! But I have one more query . For reckoning the time limit of registration of charge which period shall be taken into consideration is it actual date of creation or date of conversion of firm into Company ? Thanks in advance
