Payment of Stamp Duty on Share Purchase Agreement separately?

19 March 2026 If the transfer is through Demat and if I am paying Stamp Duty @0.015% to Depository, Do I still need to pay separate Stamp Duty on SPA in Maharashtra @0.2%? and if yes, who shall born this duty Buyer or Seller?

19 March 2026 You do not need to pay a separate 0.2% stamp duty on the SPA in Maharashtra. Since the depository collects the mandated 0.015% on the demat transfer, the state cannot charge an additional percentage-based duty on the associated documents. The buyer is legally responsible for the 0.015% duty. The SPA itself only requires a flat, nominal stamp duty of ₹500 as a general agreement under the Maharashtra Stamp Act.
