One of my client received notice regarding non filing of income tax return for financial year 2012-13.IT department has asked to give the response online. BUt client had to file the return as his income was above taxable limit. He wnts to file it now with all interest under section 234. Can return be filed now ? Also under which section return can be filed and if it is possible to file the return online. Please help.

Yes, return can be filed now.
Select section is 142(1).
Reply as 'return under preparation' through online compliance module.
Take a print out and along with that attach paper return and file before the jurisdictional ITO.
Possible to file online also.

Yes you can file return now. Ask for condonation of delay to commissioner of income tax. Otherwise file in physical form. ID Accepting it now a days.

B.Chakraprani Warrier sir thanks , ur reply is helpful... Further can we get refund from such returns ? I Mean can we file ITR of AY 2013-14 now & Get refund if we file in section 142(1)?

Yes, refund will be granted if it is legally due.
Please do not select 142(1) unless you get a communication from IT department.
If you didn't receive a communication for AY 2013-14, you may seek circular 9/2015 dated 09-06-2015 and file return manually if there is refund.

ut in that case, commissioner may not condone the delay for late filling , then what can we do ?
