27 January 2009 VWheather MSEDCL is laible for paying service Tax to Contractor who having Service Tax Reg. no. under Catrgory of Supply of Tangible Goods for Use Service if yes then Pl. send me notification or releted circuler so with the help of that i can prove that to MSEDCL division & there is one query that if releted to service tax liability no metioned in contract papers then who is labile for pay service Tax to ST depts.

27 January 2009 Whether MSEDCL is liable to pay service tax to contractors is to be deduced from the contract.

The service under reference was made taxable 16/05/2008 vide notification no. 18/2008 - Service Tax dated. 10/05/2008.
Vide this notification, the service tax provisions contained in the Finance Act'2008 was made applicable. You need to provide the notification and the Finance Act'2008 to MSEDCL. The notification can be accessed at https://www.servicetax.gov.in/notifications/notfns-2k8/st18-2k8.htm

As far as payment of service tax to Department, the service provider is liable to make the payment.
